A federal grand jury in Birmingham has indicted a Canadian man, Franc Neil Maloney, on charges of fraudulent voting. The announcement was made by U.S. Attorney Prim F. Escalona.
Maloney, 71, is a lawful permanent resident living in Blount County who has not obtained U.S. citizenship. According to the indictment, he registered to vote and participated in multiple elections despite knowing that only U.S. citizens are allowed to vote under Alabama law. The indictment states that Maloney voted in every major election since registering, including primary and general elections held in 2018, 2020, 2022, and 2024.
The case was investigated by Homeland Security Investigations (HSI), with support from the Alabama Secretary of State’s Office and IRS Criminal Investigation (IRS-CI). Assistant United States Attorney Brett A. Janich is prosecuting the case.
If convicted, Maloney faces a maximum penalty of five years in prison for the charged offense.
“An indictment is merely an allegation. All defendants are presumed innocent unless and until proven guilty in a court of law,” according to the statement released by authorities.
