Montgomery man sentenced to federal prison for illegal machinegun possession

A Montgomery man has been sentenced to federal prison for illegal possession of a machinegun, according to an announcement from Acting United States Attorney Kevin Davidson. On August 19, 2025, Alazavia Devontae Berry, age 23, received a sentence of 30 months in prison. After completing his prison term, Berry will be subject to three years of supervised release. Federal law does not allow parole.

Court records show that on September 8, 2024, officers with the Metro Area Crime Suppression (MACS) Unit attempted to stop a vehicle in Montgomery after observing a traffic violation. The driver, identified as Berry, did not comply and led police on a high-speed chase through a residential neighborhood. He left the moving vehicle—which then struck the outside of a nearby home—and tried to escape on foot before being apprehended by MACS agents. Officers found a firearm equipped with a machinegun conversion device hidden in Berry’s clothing.

Berry pleaded guilty on April 11, 2025, to unlawful possession of a machinegun.

The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), the Alabama Law Enforcement Agency, and the Montgomery Police Department as part of the MACS Unit. Assistant United States Attorney Paul Markovits prosecuted the case.

“There is no parole in the federal system,” said Acting United States Attorney Kevin Davidson.
